Governing Law:

This Agreement shall be interpreted, construed and governed by the laws of the Province of Ontario, and the federal laws of Canada applicable in the Province of Ontario, without reference to its laws relating to conflicts of law and not including the provisions of the 1980 United Nations Convention on Contracts for the International Sale of Goods. Anyone accessing this website from other jurisdictions assumes sole responsibility for compliance with the corresponding and applicable local laws. No action of Mazian Lab Equip, other than an express written waiver or amendment, may be construed as a waiver or amendment of any of these Terms and Conditions of Use or Privacy Policy. Should any clause of these Terms and Conditions of Use or Privacy Policy be found unenforceable, wherever possible this will not affect any other clause and each will remain in full force and effect.

Equipment Condition:

Some items sold by Mazian Lab Equip are pre-owned and are sold in refurbished condition. Mazian Lab Equip does not guarantee the condition of such items identical to new equipment. Some other pre-owned items sold by Mazian Lab Equip may be sold in "as-is" condition, and are not refurbished before sale. In such case customers are notified and Mazian Lab Equip is not responsible for the condition and functionality of the unit.

Availability:

Availability is subject to stock on hand and/or prior sale. The availability, delivery, and timing of some products may be contingent on providers outside of the direct control of Mazian Lab Equip. Mazian Lab Equip will make every reasonable effort to ensure that you receive all products as ordered. However, if for any reason we are unable to fulfil any part of an order, you will be entitled to a full refund for the sale price of that item. Mazian Lab Equip will not be liable for any losses other than the actual cost of equipment. If a customer is given a quote on an item or service, if a grace period is not given the quote may no longer be valid after a certain time, unless the order has been successfully made.

Repair Services:

Mazian Lab Equip staff are glad to try to service your items in need of service. Mazian Lab Equip should be notified and must accept to service every item prior shipping. If an item is sent by a customer to us without prior notice, Mazian Lab Equip reserves the right to refuse the item. However, if we recognize the item, Mazian Lab Equip reserves the rights not to service the item. Mazian Lab Equip will make very reasonable effort to repair the item as agreed; however, it is not responsible and does not guarantee the full repair of the item. By providing the item to Mazian Lab Equip, the customer recognizes this and is not entitled to any claims on the condition or functionality of the item if repairs are not successful. Serviced items are subject to the 90-day in-shop warranty (please refer to the Warranty section), unless otherwise notified. The customer is responsible for ALL transportation-related costs, at any conditions.

Equipment Rental Services:

Mazian Lab Equip offers most of the equipment available on its inventory for rent. Such equipment can be rented for an time period agreed between itself the customer. A security deposit, up to the cost of the unit, must be given to Mazian Lab Equip before the beginning of the lease. The Customer is responsible for the unit during the lease period. For the majority of equipment, Mazian Lab Equip's service team will maintain the unit during the lease period and inspect the equipment functionalities. Upon the return of the unit, it will be inspected for any possible damages and/or misuses. If such inspection fails, the customer will be liable for such damages, and the repair cost (including but not limited to labour and parts) will be subtracted from the security deposit. The unit rental costs may vary. For rental service quotations, please contact us.

Warranty:

Sold new and refurbished items are subject to a 90-day (starting from the shipping date, the date the item has been shipped by Mazian Lab Equip) limited in-shop labour and parts warranty, unless otherwise notified. However, Mazian Lab Equip's authorization is required prior shipping such items for warranty repairs. Otherwise, Mazian Lab Equip reserves the right to refuse the item and will not be responsible for providing the warranty service. Damages made during shipping or misuses of the item by the Buyer are not subject to warranty. The Buyer is responsible for all transportation-related costs. If the item is at any time serviced or repaired by a third party, the warranty voids automatically. Extended warranty periods are also available for extra fee. Please contact us for details.

Return Policy:

Most sold items (except items classified as "as-is" which are not eligible for return in any condition) can be returned to Mazian Lab Equip within the first 5 business days of the items' delivery date, unless otherwise specified. Full refund of the sale price (minus restocking fee) will be given to the Buyer under two conditions: 1) There should be no damages made to the item, and 2) The customer is responsible for all transportation-related costs. All returned items are subject to a restocking fee of 4.5% of the sales. All shipping or handling charges of the returned items are the responsibility of the Buyer. If Mazian Lab Equip pays for any other fees which are not its responsibility, that fee will also be deducted from the refund.

Taxes:

Any services or equipment sold within the Province of Ontario are subject to HST (Harmonized Sales Tax) collection,at a rate of 13% Any services or equipment sold within Canada other than Province of Ontario are subject to GST (Goods and Services Tax) collection at a rate of 5%, except with a valid tax exemption certificate provided to Mazian Lab Equip prior to the item's sale. For more information regarding GST and HST collection and exemption, please consult with Canada Revenue Agency, and Ontario Ministry of Finance. International sales and services may be subject to import duties and taxes in Canada and/or at the destination country. Any duties and taxes are the Buyer's responsibility and are paid directly by the Buyer. Mazian Lab Equip is not responsible for payment of collection of any duties and/or taxes, and it will never quote or collect any charges including but not limited to customs and tariff fees or taxes for payment to any taxing authorities. For information regarding import/export duties and taxes to/from Canada, please refer to Canada Border Services Agency.

Payments:

Mazian Lab Equip prefers to choose Canadian Dollar as the preferred currency of payment by its customers; however, we reserve the right to charge in any other currencies. We may accept major international credit cards (VISA, MasterCard, and American Express), PayPal payments, Interac e-Transfer, wire transfer, cashier's checks, bank draft, and money order as our preferred method of payment, but ONLY under certain circumstances and at our own discretion. Mazian Lab Equip reserves the right to refuse any other methods of payments, including but not limited to letters of credit. Please contact us for details.

Shipping:

Unless otherwise specified, the Buyer is responsible for all shipping and handling fees. Also, all packages are insured at the Buyer's expense, unless otherwise specified, and at the Buyer's risk. Mazian Lab Equip is not responsible for any loss or damages occurred during shipping. Buyer is responsible and highly encouraged to inspect all goods immediately upon delivery to check for shipping damage. At the time of delivery, suspected damage should be notified to the shipping agent. Buyer must document and report to the shipping company within 5 days as well as preserve packing materials and evidence of damage. Failure to do so will result in the loss of their rights to file a claim. For countries that do not accept shipping or freight insurance, Mazian Lab Equip is not responsible for lost or damaged items. Unless requested by the Buyer, Mazian Lab Equip reserves the rights at its own discretion to hire any shipping or freight companies to ship a package. Our most commonly hired courier companies are Canada Post, United Parcel Service (UPS), Federal Express (FedEx), and DHL Express, and/or their subsidiaries. Mazian Lab Equip does not guarantee and it is not responsible for any shipping cost estimations given to the Buyer (if provided). Such costs may change any time, due to the shipping company's policies. All items will be shipped out ONLY AFTER full and complete payment has been received. Once after the item is shipped out, the Buyer will be notified and provided with a shipping tracking number, ONLY if applicable. Mazian Lab Equip does not guarantee the estimated delivery time of the shipments (provided by the corresponding courier company), and is NOT responsible for any losses due to any delays in delivery.

Privacy Policy:

Mazian Lab Equip respects your rights to privacy and uses the personal information voluntarily given to us by you through any forms of communication (email or postal messages, telephone conversations, or completing paper or electronic forms). Your communication with us unconditionally grants the right for Mazian Lab Equip to contact you at its convenience. Any information provided to us will be treated as private and confidential to us and will be kept confidentially, and securely kept by us and not subject to disclosure to any third parties, except as required or permitted by law. Any information provided to us will be used by Mazian Lab Equip to respond to your inquiries and to provide you with updates and information that we may deem to be of interest to you, including but not limited to offers and promotions of our equipment and services. However, Mazian Lab Equip is not responsible and does not guarantee the confidentiality and security of the paper based and electronic communications (such as email and electronic form submission) with itself. Mazian Lab Equip is not liable to the content, conditions, or availability of the external links on this website to other websites. This website does not actively make use of cookies (text files often used to distinguish repeated visits to a certain website) to store any information on the client browser.
